WORKSHOP TERMS & CONDITIONS
By completing the registration form for a particular workshop, you are agreeing to the terms and conditions set out below (“Terms”) and they will be incorporated into the contract between us (“Contract”). You will ensure that any other person attending the Workshop on your behalf or with you shall comply with these Terms. The Contract is formed when we send you a booking confirmation.
The terms below apply for all Free In Spirit Creative's workshops and classes.
1. REFUNDS/CANCELLATIONS – PUBLIC WORKSHOPS
Refunds of workshop fees will only be given if:
The workshop is cancelled or rescheduled due to teacher illness or insufficient enrolments. Minimum enrolments are required for all workshops.
Should a workshop have to be cancelled due to insufficient enrolments or teacher illness, all participants enrolled in that workshop will be contacted and an alternative workshop or a full refund will be arranged within 7 business days.
If you choose to withdraw from a workshop up to 14 days before its commencement, you will be charged a $25 administration fee and the remaining amount refunded as soon as possible.
When a refund cannot be provided
Free In Spirit Creative cannot accept responsibility for changes to participants' personal circumstances that prevent attendance, or “change of mind” or “postponements due to Government restrictions”:
If you choose to withdraw/cancel within 14 days of the workshop date, no refund can be provided, only a credit to a future workshop (of the same value) to be used within 12 months. You can, however, transfer the credit to a workshop of higher value and pay the remaining fee owing.
It is the participant’s responsibility to ensure they remember to attend a workshop. If you forget the date, your ticket is non-refundable. A credit to a future workshop (of the same value) may be offered (valid for 12 months).
Government Restrictions including (but not limited to) National and Worldwide Pandemics.
Refunds/Cancellations – Private Workshops/Parties
All private workshops and parties require a non-refundable 50% deposit of the total amount within 7 days of the booking being confirmed. Full payment is required 7 days before the workshop date.
Cancellation of the workshop must be provided in writing to Free In Spirit Creative as soon as possible. The deposit amount of 50% is not refundable. If final payment has been received and the workshop is cancelled within 7 days of the workshop, the final 50% payment is refundable only.
Workshops will be postponed if Government Restrictions including (but not limited to) National and Worldwide Pandemics are implemented and no refund will be provided. The workshops will be rescheduled when able or credits provided to future workshops.
2. YOUR OBLIGATIONS
If you act in any way which in our opinion is likely to cause any harm or nuisance to any person at the Workshop, you will be required to leave the Workshop and we shall not be liable to refund your Ticket Fee or any other payment.
You must comply at all times with the health and safety policy of the venue. You must comply with all requests from us or the venue with regard to health and safety and failure to do so will result in you being asked to leave the workshop (in which case no refund will be provided). You may not bring any equipment or items of a hazardous or dangerous nature to the Workshop.
You shall not cause any damage to any part of the venue (including outside areas, and all inside walls, flooring, fixtures and fittings). You are solely liable for any damage caused by you, your employees, contractors, sub-contractors and agents to any such area of the venue and shall fully reimburse us in relation to any damage so caused.
You must keep your personal belongings with you at all times and we accept no liability for any damage to, loss of or theft of any of your belongings or other items brought to the Workshop by you.
3. LIMITATIONS OF LIABILITY
Whilst every reasonable precaution is taken by us to ensure security and safety at the workshop, we shall not in any way be liable for any loss or damage suffered by you whatsoever in relation to the Workshop, save that nothing in these Terms shall be deemed to limit the liability of any person for death or personal injury caused by negligence.
Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, any fraudulent misrepresentation or any other liability for which it is unlawful to exclude or limit liability.
Our total liability for any matter arising out of the Contract shall in all circumstances be limited to the price paid by you for the Workshop and we shall not in any circumstances be liable to you for any consequential loss whatsoever.
4. PHOTOGRAPHY & VIDEO
Photos and/or videos may be taken during the Workshop for marketing purposes. If you do not wish to be photographed, please let the Instructor know before the Workshop starts. Photography and/or video will be used to promote workshops and events via social media, marketing materials and my website.
